Trump Mistreatment Claim Over Affidavit 'Pure Disinformation': McQuade - Newsweek

Former U.S. attorney and legal analyst, Barbara McQuade, criticized former President Donald Trump's lawyer Lindsey Halligan on Sunday about a claim she made earlier this week about the FBI's Mar-a-Lago search warrant affidavit.

During a Friday appearance on Greg Kelly Reports on Newsmax, Halligan said that there was a "lack of transparency" by authorities when it comes to the affidavit.

"We want to review the affidavit for ourselves. They are very selective in terms of what they want out there and we definitely want to know what they're claiming they have as evidence. So, their withholding of information is essentially controlling the flow of information and that is the first step to tyranny," she said.

However, McQuade pushed back against Halligan's remarks on Twitter and tweeted that "search warrant affidavits are sealed in every case until after charges are filed. This claim of mistreatment is pure disinformation."

Magistrate Judge Bruce Reinhart heard arguments from media organizations on Thursday as they called for the release of the affidavit so the public can understand the reasoning behind the FBI's raid on Trump's Mar-a-Lago resort residence earlier this month.

Reinhart agreed that some parts of the affidavit will likely be unsealed after the Department of Justice (DOJ) submits proposed redactions to the document by August 25.

The judge signed off on the warrant allowing the FBI to search Mar-a-Lago as part of an investigation looking into the way White House documents were allegedly handled after the then-president left office last January. The judge recently released the search warrant after the DOJ asked for it to be made public.

The FBI recovered classified documents during their search that reportedly included information related to nuclear weapons and "highly classified programs," among other secret sensitive information. The search was approved by Attorney General Merrick Garland, with the purpose of looking for top secret (TS) and sensitive compartmentalized information (SCI) as well as other classified documents.

Sources told Newsweek that the raid was based on a tip that authorities received from an informer who knew the type of documents Trump kept and their location.

Trump's office recently said that he had a "standing order" to declassify the White House documents before moving them to his home. McQuade said last weekend during an appearance on MSNBC's The Katie Phang Show, that it likely will not matter much in court given the laws cited on the FBI's search warrant.

McQuade stepped down from her position in 2017 after serving for seven years as the U.S. attorney for the Eastern District of Michigan. She left her position amid Trump's request for the resignation of 46 U.S. attorneys during his presidency.
